Woman charged with domestic assault after physical altercation
Autumn S. Dulaney, 40, of Isabella, was scheduled to appear for a bond appearance hearing Tuesday in connection with a case in which she’s charged with domestic assault. Results of that hearing was not available at presstime.
According to the probable cause statement prepared by Ozark County Sheriff’s Deputy Josh Sherman, at 5:24 p.m. March 6 the OCSD dispatch office notified the officer of a physical domestic disturbance in process at a residence in Isabella.
“Prior to our arrival, I was made aware that the Missouri 12-hour rule was in place for these two individuals for a prior domestic disturbance that had not yet expired. The prior incident was reported to have been handled by Deputy [Stephen] Ator and Sheriff [Cass] Martin,” Sherman wrote in his report. “As the female approached me, I directed her to go speak with the other officer, as I made my way to speak with the male individual involved.”
Sherman noted that he noticed that Dulaney smelled of intoxicants when she spoke to him.
The man, whose name is not included in court documents and is referred to as a confidential victim, reportedly told Sherman that Dulaney struck him across the face and caused a bloody nose and pinned him to the ground as she continued to argue with him.
He told the officer that he wished to pursue charges.
“Autumn was arrested for domestic assault in the third-degree and booked into the Ozark County Jail as she violated the 12-hour rule... [and] was identified as the primary physical aggressor pursuant to Missouri Statute,” Sherman’s report concluded.
Dulaney is being charges as a “prior and persistent offender” due to her past criminal record which includes a Feb. 2, 2010, conviction of felony driving while intoxicated in Douglas County and a March 27, 2012, conviction of felony possession of a controlled substance in Webster County. The designation means that if convicted of the domestic assault charge in the open case, Dulaney will be subject to extended punishment.
