Pleas heard, warrants issued during law days

Several cases were concluded and continued during the Ozark County law days of July 22 and Aug. 5.

A trial is set for Chevy Logan in December with a pre-trial scheduled for Nov. 11. Mahan is charged with first degree rape or attempted rape.

During an appearance on Aug. 5, Logan’s attorney requested that the no bond condition of his pre-trial arrest be reconsidered. Though the state opposed, Judge Carter granted pre-trial release with supervision by Court Probationary Services with GPS monitoring and house arrest.

 Hearings

Both a sentencing hearing and a probation violation hearing were held for Michael L. Jones.

Jones was sentenced to two years in the DOC through a 120-day program to run concurrent with all other cases. He previously pleaded guilty to charges of unlawful possession of a firearm with possession of a controlled substance dismissed pursuant to a plea agreement.

He also had his probation revoked and was also sentenced to two years in the DOC in the 120 day program to run concurrent with all other cases (see story on page 14).

A motion to suppress hearing was held July 22 for Lashanna Lambert. After hearing the attorney’s thoughts and testimony of three witnesses, Judge Craig Carter overruled the defendant’s request to suppress evidence. She is set to appear at 9 a.m. Sept. 9 (see story on page 13).

Guilty pleas

Jessie Don Cullen entered pleas of guilty to possession of a controlled substance in one case and to second degree burglary and stealing $750 or more in a second case. Pursuant to a plea agreement, charges of receiving stolen property and unlawful possession drug paraphernalia were dismissed. Cullen was sentenced to 5 years in prison in the 120 day program on both cases to run concurrent. She is also ordered to pay restitution and a restitution hearing is scheduled for 9 a.m. Sept. 9. Franke J. Frunzi entered a plea of guilty to possession of controlled substance. He was sentenced to suspended imposition of sentence and 5 years probation. Pursuant to a plea agreement the charge of unlawful possession of drug paraphernalia with a prior drug offense was dismissed.

Willie T. Clemmer Jr. entered a plea of guilty to the charge of forgery. He was sentenced to 10 years in the DOC, SES to run concurrent with a Douglas County case. He was also ordered to pay restitution of $6,356.

Warrants issued

A capias warrant was issued for Dylon James Powell when he failed to appear for his scheduled court appearance on July 22. He is scheduled to appear at 9 a.m. Sept. 9.

A capias warrant was also issued for Troy A. Santacroce when he failed to appear for his scheduled court date of July 22. He is scheduled to appear at 9 a.m. Sept. 9.

A capias warrant was issued for Shanna Dawn Cunningham after she failed to appear for her July 22 hearing. A capias warrant was issued and remained outstanding after she also failed to appear for her Aug. 5 hearing.

Not guilty pleas

Sylvia Joe Wages entered a plea of not guilty to first degree sexual abuse. He is set to appear at 9 a.m. Sept. 9.

Shane William Cook entered a plea of not guilty to charges of stealing $750 or more, two counts of possession of controlled substances, two counts of unlawful use of a weapon by possession weapon and a felony controlled substance, hindering prosecution of a felony and unlawful prossession of drug paraphernalia. During his  appearance on Aug. 5, Cook tested positive for meth and alcohol. He was ordered to be continued on probation after serving 7-day shock in the Ozark County Jail. He is scheduled to appear at 9 a.m. Sept. 9.

Travis Lee Riley entered a plea of not guilty to charges of driving while revoked or suspended and failure to display plates on a motor vehicle. He is set to appear at 9 a.m. Sept. 9.

Eugene Collins Clayton entered a plea of not guilty to charges of DWI - chronic, 3rd and subsequent offense of operating a vehicle on the highway without a valid license, second and subsequent offense of failure to maintain financial responsibility- motor vehicle required to be registered, and failure to drive on right half of roadway when roadway was of sufficient width. He is scheduled to appear at 9 a.m. Sept. 9.

Jasper F. Scribner entered a plea of not guilty to the charge of driving while revoked. He is set to appear at 9 a.m. Sept. 9.

Bethany Dawn Schaefer entered a plea of not guilty to charges of possession of a controlled substance, unlawful uses of a weapon by possessing a weapon and a felony controlled substance, and unlawful possession of drug paraphernalia. She will be released to a sober living program after serving 7-day shock detention in the Ozark County Jail. She is set to appear at 9 a.m. Oct. 7.

Probation revoked 

Probation was revoked for James T. Young and he was sentenced to 4 years in the Missouri Department of Corrections with credit for time served. The sentence will run concurrently with all other charges. (See story on page 15)

Continued on probation

Brandon C. Mills was ordered to be continued on probation after serving a 7-day shock detention in the Ozark County Jail. He was also ordered to be screened for treatment court and scheduled to appear at 9 a.m. Sept. 9.

Also continued on probation were Kandace Newton, Michael S. Burkeen, Auden M. Vaneperen, Jared W. Johnston, Corey Smith and Simon Sullivan.

Other cases

Robert P. Kelley was ordered to complete a 7-day shock detention in the Ozark County Jail. He is scheduled to appear at 9 a.m. Sept. 9.

Cases continued

Twenty-eight other cases were also continued to Sept. 9.

Three cases were continued to Sept. 23, one case was continued to Oct. 21 and one case was continued to Dec. 23.
