Three probation violators sentenced to jail or prison during Feb. 7 Ozark County Law Day

Circuit Judge Craig Carter sent three defendants to prison and one to jail after the Feb. 7 session of Ozark County Law Day. Carter processed a total of seven civil cases and 30 criminal cases that day. 

 

Sent to prison

Dewayne R. Allen, who was convicted of unlawful possession of a firearm by a dangerous felon in Nov. 2021, appeared for a probation violation hearing after he was terminated from drug court. He admitted to violating his probation. His original 4-year Missouri Department of Corrections prison sentence was executed, and he was turned over to MoDOC. 

 

Sent to 120-day prison program

Timothy Kyle Sprague, who was convicted of voluntary manslaughter in July 2020 and is on probation in that case, appeared for a probation violation hearing after having two new pending domestic assault charges filed against him. He admitted to violating his probation, and he was sent to prison under a 120-day institutional drug treatment program. He has a 15 year back-up sentence. Online records indicate he will submit a plea on the new domestic assault cases in approximately 60 days. He is ordered to return to court on those cases on June 5.

Samuel J. Deatherage, (See related story above) pleaded guilty pursuant to a plea agreement to amended charges of assault and discharging a firearm at a person. He was sentenced to a 120-day institutional drug treatment program within the MoDOC and ordered to get his GED. If he completes the program successfully, he will be released on probation. He has a 10-year backup prison sentence that can be executed by a judge if he violates his probation enough times. 

 

Shock jail time

Michelle Wilcox, who was convicted of possession of a controlled substance in Oct. 2021, appeared for a case review. Last month she reported that she had not been accepted into the Turning Leaf drug rehab due to no open beds, the docket says. She was tested for drugs on the day of the court hearing, and she tested positive for methamphetamine. She was ordered to serve 7 days shock incarceration in the Ozark County Jail and then appear back in court on Feb. 21. 

 

Case complete

Angela Brake, who was convicted of assault in Sept. 2017, appeared and was discharged from probation successfully. Her case is now complete. 

 

Continued on probation

Dylan Burke, who was convicted of possession of a controlled substance in Dec. 2022, had a probation violation hearing. He was ordered to complete treatment at Behavioral Health Center. He was continued on probation. 

 

Return to court Feb. 21

Michael Scott Strickland, who was convicted of burglary in 2018, had a capias warrant issued for his arrest. It was served the same day, and he was arrested. The probation violation hearing is now scheduled for Feb. 21.

Steven Long, charged with four counts of driving with a revoked or suspended license in four different cases, was scheduled for plea hearing or trial setting but didn’t appear because he was in jail in Taney County on another case where he’s charged with driving while intoxicated as a habitual offender. The hearing was continued to Feb. 21. 

Jerimiah Love, charged with possession of a controlled substance, unlawful use of a weapon (possessing a weapon and felony level controlled substance), harassment, domestic assault, property damage and unlawful possession of drug paraphernalia, was arraigned. A plea hearing or trial setting is scheduled for Feb. 21. 

 

Return to court March 6

Kimberly Hemphill, charged with possession of a controlled substance, did not appear for a motion hearing. A show cause hearing is scheduled for March 6. 

Christopher Campbell, charged with possession of a controlled substance and unlawful possession of drug paraphernalia for methamphetamine in one case, two counts of possession of a controlled substance, delivery of a controlled substance at a county jail, unlawful possession of drug paraphernalia for methamphetamine and two counts of resisting arrest for a felony in a second case, had his plea hearing or trial setting continued to March 6 because he was currently in prison. 

Juston Ralph Stoneking, charged with harassment, domestic assault and unlawful possession of a firearm, had a criminal setting scheduled for March 6. 

Charles K. White, charged with driving with a revoked or suspended license (felony), was scheduled to appear for a show cause hearing. His bond conditions were amended to being tested for drugs/alcohol once a week. A plea hearing or trial setting is scheduled for March 6. 

Brandon Guidry, charged with possession of a controlled substance, unlawful possession of drug paraphernalia for methamphetamine and unlawful possession of a firearm in one case, and unlawful possession of a firearm, terrorist threat and damage to jail/jail property in a second case, was arraigned. A plea hearing or trial setting is scheduled for March 6. 

 

Return to court March 20

Timothy William Kendrick, charged with driving with a revoked or suspended license (felony), had her plea/trial setting continued to March 20. 

Brian E. Mottus, charged with unlawful possession of drug paraphernalia and possession of a controlled substance in one case and operating a vehicle on a highway without a valid license in a second case, was scheduled for plea hearing or trial setting. It was continued to March 20. He had filed a motion to decrease the amount of drug/alcohol testing required, but that motion was overruled.
