Theodosia man racks up another felony charge after failing to show up at his December jury trial

Noel Cole, 48, of Theodosia, is being held in the Ozark County Jail on a $2,500 bond in connection with a newly filed case where he is charged with failing to appear in court. 

According to the probable cause statement prepared by Ozark County Deputy Josh Sherman, on Dec. 21, 2023, Cole was scheduled for a criminal trial Dec. 21-22. He had been released on his own recognizance by court order prior to the trial, and did not show up for the trial, which had to be canceled due to his absence. 

Due to the failure to appear, Cole now faces another felony charge, a class E felony.

He was arrested March 7 and has been held in jail since. A bond reduction hearing is scheduled for 9 a.m. April 23. 

In his underlying cases for which the jury trial was scheduled, Cole faces two counts of resisting arrest, and one count of felony assault. A new jury trial has been scheduled for April 11-12 as a number two setting.
