Merriman released to residential rehab program
Orval “Donnie” Merriman appeared during the Nov. 6 session of Law Day with his attorney Rodney Daniels appearing via video conference.
Merriman, who is charged with second degree drug trafficking and unlawful possession of drug paraphernalia - amphetamine or methamphetamine, asked to be released in order to attend the sober living 6-month residential program Standing by the Door in Branson. During his appearance on Oct. 23, Merriman was taken into custody by the Ozark County Sheriff’s Office.
Ozark County Prosecuting Attorney Lee Pipkins objected to the release because previous outpatient services had not prevented Merriman from abusing drugs. “He had a chance, but he tested positive four times,” said Pipkins.
Pipkins also informed the court that Merriman had 12 prior felony convictions and new charges had been filed. Three counts of possession of a controlled substance and one count of resisting or interfering with arrest for a felony were filed Oct. 7.
Judge Carter ruled that the defendant could be released to Standing by the Door as long as the program immediately informed the court of any violations.
“Thank you, your honor,” said Merriman.
“Don’t make me regret it,” said the judge.
Merriman is scheduled to appear at 1:30 p.m. Jan. 22, 2025, for review.
