Man charged after reportedly firing slingshot at neighbor, claims he was trying to hit a cat

Timothy Frye, 67, of Theodosia, was arraigned Nov. 20 and is being held in the Ozark County Jail without bond in a case in which he’s charged with harassment and assault of special victims. 

According to the probable cause statement prepared by Ozark County Sheriff’s Lt. Matt Rhoades, at 9:30 a.m. Nov. 18, the officer was assigned to a call of an assault at the victim’s residence. The report says that one of the victims said his neighbor, Timothy Frye, had shot a rock at him with a slingshot. 

“Victim #1 was sitting inside his laundry room, smoking a cigarette at an open window. The subject saw him and shot a rock at him with a sling shot but missed,” Rhoades’ report says. “He showed me a video of the suspect walking along the fence line right after he shot the rock.”

The victim said he desired prosecution. The report says that he is disabled, confined to a wheelchair and has no legs, which qualifies him as a special victim in the charge. 

Rhoades said he identified the suspect as Frye from previous interactions with the man. 

The report says that the other victim, identified as Victim #2 in the probable cause statement, told the officer that Frye threatened to kill her on Sept. 27, as he stood outside their home on the road. He also tried to challenge her to come out onto the front lawn and fight him, the report says. 

Rhoades located the suspect at his house and spoke to him about hte allegations. “He stated he fired his sling shot at a cat, missed and the marble hit a fence post, ricocheted and struck the victim’s house,” Rhoades said. “He showed me the slingshot and the shirt he was wearing in the video on a chair in his living room.”
