Judge sends probation violator to prison, concurrent with Douglas County case

Circuit Judge Craig Carter processed a total of 21 cases during the April 17 session of Ozark County Law Day. Updates on the criminal cases are listed here:

 

Sent to prison for probation violation

Colt York admitted to a violation of his probation by failing to pay court costs and restitution and by being arrested and charged in a separate case in Douglas County. He appeared via Webex from the Douglas County Jail. York’s probation was revoked, and he was sent to the Missouri Department of Corrections for 4 years. The sentence is to run concurrently with a 4 year sentence from Douglas County. He will get credit for time served in the Ozark County Jail and the Douglas County Jail. He was originally charged with leaving the scene of an accident with property damage.

 

Arraignments

Patricia Anna Santos Duvalier waived arraignment and reading of the charges and pleaded not guilty to abuse of an elderly, disabled or vulnerable person and charges of financial exploitation of an elder/disabled person. Her cases were continued to July 17. Duvalier was charged October 2023 in connection to the alleged abuse and financial exploitation of a 37-year-old mentally disabled woman and her bedridden, elderly mother. Duvalier was a paid caregiver for the two women. The 37-year-old woman died Oct. 12, 2023. Duvalier has the option of changing her not guilty plea to a guilty plea as the case proceeds. 

Daniel Eric Johnson waived arraignment and reading of the charges and pleaded not guilty to third-degree domestic assault, tampering or attempting to tamper with a victim in a felony prosecution and violation of an order of protection. His cases were continued to July 17. He has the option of changing his not guilty plea to a guilty plea as the case proceeds. 

Carl Edward Foster waived arraignment and reading of the charges and pleaded not guilty to possession of a controlled substance, third-degree assault and unlawful possession of drug paraphernalia. His case was continued to 9 a.m. June 5. He has the option of changing his not guilty plea to a guilty plea as the case proceeds. 

 

Probation conditions review

A probation conditions review was held for William Hill, originally charged with first-degree property damage. He was continued on probation. 

 

Warrants issued

Steven Long, charged with a probation violation, failed to appear for his hearing. A warrant was issued. 

Adam D. Bartlett Jr., charged with resisting arrest/detention/stop by fleeing-creating a substantial risk of serious injury/death to any person, operating motor vehicle in a careless and imprudent manner, and stealing-value less than $150 and no prior stealing offense, failed to appear for his arraignment. According to Ozark County Prosecuting Attorney Lee Pipkins, Bartlett had been in the Missouri Department of Corrections but is now in the Howell County Jail. He scheduled to appear May 3 before Associate Judge Raymond Gross. A capias warrant was issued.

 

Scheduled or continued to May 1

Michael Renee, charged with possession of a controlled substance from a May 2020 incident. A probation violation hearing is scheduled for 9 a.m. May 1. New charges have been filed against Renee. According to Pipkins, the victim in the case has stated that she will be uncooperative.

Clifton Roark, charged with financial exploitation of an elder/disabled person. A plea hearing or trial setting was continued to 9 a.m. May 1.

Justin P. Bell, charged with possession of a controlled substance and unlawful possession of drug paraphernalia-prior drug offense. A plea hearing or trial setting was continued to 9 a.m. May 1.

 

Scheduled or continued to May 22

Herbert Palmer, charged with failure to appear. A plea hearing or trial setting is scheduled for May 22.

 

Scheduled or continued to June 5

Charles K. White, charged with two counts of driving while revoked and one count of DWI-aggravated. A plea hearing or trial setting is scheduled for 9 a.m. June 5. 

Taylor French, charged with first-degree tampering with a motor vehicle and misdemeanor stealing. A plea hearing or trial setting is scheduled for 9 a.m. June 5.
