Gainesville man indicted on charge of possessing a dozen Xanax tablets

An Ozark County grand jury has indicted Dylan Michael Burke, 25, of Gainesville with the class D felony charge of possession of a controlled substance. He was arrested Dec. 27, 2022, and arraigned the next day. 

He was released on his own recognizance with supervision by Court Probationary Services on Jan. 3. He appeared before Circuit Judge Craig Carter and was remanded to the custody of the sheriff’s office for seven days after testing positive for marijuana and alcohol. He remains in custody and is scheduled to appear today for a plea hearing or trial setting.

According to the probable cause statement prepared by Deputy Matt Rhoades, the officer stopped Burke’s vehicle at 12:55 a.m. (after midnight) on Dec. 11, 2022, because it did not have a front license plate. The officer conducted a search of the vehicle and found 12 Alprazolam pills, the generic name for the drug Xanax.

No one else was in the vehicle, and Burke does not have a prescription for the medication, the report says. 

If convicted of the class D felony charge, Burke will face up to 4 years in prison.
