Caulfield woman charged with domestic assault, burglary

Courtney Duke, 30, of Caulfield, has been charged with the class B felony of burglary and the class C felony of domestic assault. She was arraigned Sept. 12 and is scheduled to reappear in court Sept. 27.

The complaint in the case states that Duke is charged with burglary for, “knowingly remained unlawfully in an inhabitable structure…for the purpose of committing domestic assault…and while in such inhabitable structure, the defendant caused immediate physical injury to [a woman], who was not a participant in the crime.”

The charge of domestic assault is charged because, she “knowingly caused physical injury to [a woman] by striking [a woman] arm with a door causing a laceration and abrasions and [a woman] and the defendant were family…”

According to the probable cause statement written by Ozark County Deputy Jeff Lane says that he was dispatched to a home in Caulfield at 8:20 p.m. Aug. 10.

Lane spoke with Duke and her mother on scene.

“I asked Courtney what had taken place. She stated her husband… left the residence with the children, so she followed him to take the kids back home. Once on the property of [other family members], Courtney was told she needed to leave and she did not need the children. Courtney attempted to get the children from the home, and [a woman] shoved her away from the house. [The woman] informed Courtney to leave the property to which she continued to attempt entering the residence resulting in a small cut on the forearm of [the woman’s] left arm while attempting to remove Courtney from her residence,” the report says. “Once removed from the residence Courtney continued shouting from the yard refusing to leave the property until authorities arrived on scene.”

If convicted of the class C felony, Duke faces up to 7 years in prison.
