Carter sends one to prison, one to jail

 

Circuit Judge Craig Carter processed 22 criminal cases during the Dec. 7 session of Ozark County Law Day. Updates are listed below. 

Law Day sessions, when felony-level cases are brought before the circuit judge, are held twice a month in the upstairs courtroom in the Ozark County Courthouse. Proceedings are open to the public. 

 

Sent to prison for violating probation

Samantha Rodak-Triboulet, who pleaded guilty to burglary in January 2019, appeared for a probation violation hearing. She admitted to violating her probation, and her probation was revoked. She was sentenced to three years in the Missouri Department of Corrections on each count. 

 

Shock jail sentence for violating probation

Michael S. Szabo, who pleaded guilty to possession of a controlled substance, appeared for a probation violation hearing after serving a 7-day shock jail sentence for violating his probation. He was ordered to be screened to enter the 44th Judicial Circuit’s drug court program, a substance abuse rehabilitation effort. He is scheduled to return to court at 9 a.m. Jan. 4, 2023. 

 

Case complete

Samuel Leonard Havens, who pleaded guilty to driving while intoxicated (aggravated offender), appeared for a probation review. He paid all costs in the case. The case was marked complete, and he was discharged from probation. 

 

Probation violation hearings

Jennifer Winters, who pleaded guilty to possession of a controlled substance in July 2018, appeared for a probation violation hearing. It was continued to Dec. 21. She was remanded to the custody of the Ozark County Sheriff. 

Hailie J. Spears, who pleaded guilty to possession of a controlled substance, was scheduled to appear for a probation violation hearing. It was continued to 9 a.m. Feb. 8. 

 

Pre-trial conference

Matthew B. Woolin, charged with two counts of domestic assault, was scheduled to appear for a pre-trial conference before his Dec. 15-16 jury trial. 

 

Scheduled or continued to Dec. 21

Timber Hamilton, charged with tampering with a judicial officer, was scheduled to appear for a plea hearing or trial setting. The court conducted a Faretta hearing and read him a right to self-representation questionnaire. The judge found that Hamilton could not knowingly and voluntarily represent himself.  He was remanded to the custody of the Ozark County Sheriff and ordered to return to court at 1:30 p.m. Dec. 21. 

Michael S. Burkeen, charged with assault, armed criminal action, unlawful use of a weapon (shooting at a person, motor vehicle or building) and receiving stolen property in one case and burglary and two counts of stealing a firearm in another case, was scheduled to appear for a plea hearing or trial setting. It was continued to 1:30 p.m. Dec. 21. 

Blake Dalton White, charged with rape and statutory rape (victim younger than 14) and two counts of statutory sodomy (deviate sexual intercourse, person younger than 14), was scheduled to appear for a plea hearing or trial setting. It was continued to 1:30 p.m. Dec. 21. The online court records show that an expert has examined the defendant.

Sarah Adams, charged with two counts of domestic assault (serious physical injury), two counts of abuse or neglect of a child (serious emotional or physical injury - no sexual contact), unlawful use of a weapon (exhibiting), kidnapping and three counts of endangering the welfare of a child creating substantial risk (no sexual contact), was scheduled to appear for a plea hearing or trial setting. It was continued to 1:30 p.m. Dec. 21. All parties and counsel are required to appear, the docket says. 

Dakota Maynard, charged with promoting child pornography to a minor and a possession of child pornography in one case and damage to jail property in another case, was scheduled to appear for a plea hearing or trial setting. It was continued to 1:30 p.m. Dec. 21. 

Michelle Wilcox, charged with possession of a controlled substance, was scheduled to appear for a plea hearing or trial setting. It was continued to 1:30 p.m. Dec. 21. 

Mark Kenneth Lowry, charged with two counts of domestic assault, two counts of sexual abuse, kidnapping and robbery, was scheduled to appear for a plea hearing or trial setting. It was continued to 1:30 p.m. Dec. 21. 

Alicia Vandiver, charged with endangering the welfare of a child (serious physical injury), was scheduled to appear for a plea hearing or trial setting. It was continued to 1:30 p.m. Dec. 21. 

Jason M. Laird, charged with burglary and five counts of stealing a firearm and unlawful possession of a firearm, appeared for a plea hearing or trial setting with his attorney Jason MacPherson. It was continued to 1:30 p.m. Dec. 21. 

Sondra F. Clark, charged with second-degree murder, was scheduled to appear for a bond review hearing. It was continued to 1:30 p.m. Dec. 21. 

 

Scheduled or continued to  Jan. 4

Tiffany Bauer, charged with violating a condition of lifetime supervision, was scheduled to appear for a plea hearing or trial setting. It was continued to 9 a.m. Jan. 4. 

 

Scheduled or continued to  Feb. 8

Charles David Cole, charged with assault of a special victim, assault (first degree), assault (third degree), stalking, terrorist threat and property damage, is scheduled for a plea hearing or trial setting. It was continued to 9 a.m. Feb. 8. 

Trevor White, charged with assault (first degree or attempt, serious injury or special victim), assault (first-degree or attempt) and two counts of armed criminal action, was scheduled to appear for a plea hearing or trial setting. It was continued to 9 a.m. Feb. 8. 

 

Warrant issued

Reagan Jenkins, charged with stealing (all other property) and fraudulent use of a credit or debit card, did not appear for a plea hearing or trial setting. A capias warrant, meaning one with no bond and full extradition rights, was issued for her arrest. She was later arrested on Dec. 11.
