Carter holds Dec. 6 OC Law Day

Circuit Judge Craig Carter processed six civil cases and 37 criminal cases during the Dec. 6 session of Ozark County Law Day. Updates on the criminal cases are listed here:

 

Plea, sentencing

Aaron Bradley Perry pleaded guilty to burglary, two counts of domestic assault and unlawful possession of a firearm and was sentenced to 7 years in the Missouri Department of Corrections.

 

Warrant issued

Kimberly D. Hemphill, charged with possession of a controlled substance, did not appear for her plea hearing or trial setting. A capias warrant was issued. 

Michael L. Jones, charged with stealing a motor vehicle and possession of a controlled substance, did not appear for his hearing. An already outstanding capias warrant had been issued and is still active.

 

Released for drug treatment

Linda Ann Schwalm, charged with possession of a controlled substance, keeping or maintaining a public nuisance and unlawful possession of drug paraphernalia, appeared with her attorney. She had tested positive for methamphetamine again. She was released to an inpatient treatment facility only, and upon completion she should return to custody, the docket says. Her plea hearing or trial setting was continued to Jan. 3. 

 

Jury trial scheduled

Patrick K. Lee, charged with burglary, domestic assault and robbery, appeared with his attorney. Copies of the defendant’s texts to the attorney will be provided by the state due to communication miscues, the online docket says. His case was set for jury trial May 23-24, 2024. 

 

Probation complete

Corey Pool, who was convicted of domestic assault in May 2021, has completed probation. 

 

Shock jail sentence for probation

Melvin Campbell, who pleaded guilty to burglary and stealing a firearm in June 2020, appeared and admitted to using methamphetamine and marijuana the day before. He was remanded to the sheriff’s custody. He is set to return to court for a probation violation hearing Jan. 3, 2024. 

Michael Renne, who was convicted of possession of a controlled substance in March 2021, appeared for a probation violation hearing. He had served 7 days in jail for the violation. He was continued on probation and ordered to return to court on Jan. 17, 2024. Attorney Joshua Brown filed his appearance in the case. 

 

Continued on probation

Andrea Greer, who was convicted of burglary and stealing a firearm in October 2019, had a probation conditions review hearing. The online docket says that the defendant is in school, obtaining her GED and working. She was continued on probation.

 

Scheduled or continued to Dec. 20

Tyler Hogan, charged with possession of a controlled substance, had his plea hearing or trial setting continued to 1:30 p.m. Dec. 20.  

Anna R. Deatherage, charged with leaving the scene of an accident with property damage exceeding $1,000, had her plea hearing or trial setting continued to 1:30 p.m. Dec. 20. Online records show that she’s scheduled to appear for a show cause hearing as a non-compliance violation report was filed for her bond release. 

James C. Reed, charged with harassment, discharging or shooting a firearm at a vehicle/person/building, attempted armed criminal action and tampering with a motor vehicle, did not appear for his arraignment. He is scheduled for a show cause hearing at 1:30 p.m. Dec. 20. 

Charles K. White, charged with two counts of driving with a revoked or suspended license (felony), driving while intoxicated (aggravated offender), failed to appear. A warrant was issue but then recalled. He is scheduled to appear for a plea hearing or trial setting at 1:30 p.m. Dec. 20. 

Jody Weyrauch, charged with trespassing and property damage, had his arraignment continued to Dec. 20 because he was in custody in Douglas County Jail. 

 

Scheduled or continued to Jan. 3

Michael Scott Strickland, who pleaded guilty by Alford plea to burglary in May 2022, had his hearing continued to Jan. 3. 

Brian Mottus, charged with operating a vehicle without a license, unlawful possession of drug paraphernalia and possession of a controlled substance, was arraigned. He is scheduled to return for a plea hearing or trial setting. 

Carrie Laird, who was convicted of possession of a controlled substance in July 2023, appeared. She had violated her probation and completed a 7-day shock jail sentence. She had drug court contract signed, online records show, indicating she’ll enter the program. 

William Chamberlain, charged with possession of a controlled substance and unlawful use of drug paraphernalia, had his plea hearing or trial setting continued to 1:30 p.m. Feb. 21; however, a non-compliance report was filed for his bond release and he’s ordered to appear for that on Jan. 3. 

Steven Long, charged with seven counts of driving with a revoked or suspended license (felony), possession of a controlled substance, appeared with his attorney. He was released to Court Probationary Services with drug and alcohol testing twice a week. On Dec. 13, a non-compliance report was filed, and he was ordered to appear for a bond review hearing on Jan. 3. 

 

Scheduled or continued to Jan. 17

Kenneth R. Cowart, who was convicted of unlawful use of a weapon (exhibiting) in April 2021, appeared for a probation violation hearing. The online docket says that he has new charges pending in associate court. The probation violation hearing was continued to Jan. 17. 

Mary Polen, charged with possession of a controlled substance, unlawful possession of drug paraphernalia for methamphetamine and maintaining a public nuisance, had her plea hearing or trial setting continued. A non-compliance report was filed for her bond release, and she is scheduled to also have a hearing for the violation. 

Juston Ralph Stoneking was arraigned on charges of harassment, domestic assault and unlawful possession of a firearm. A plea hearing or trial setting is scheduled for Jan. 17. 

Todd J. Chapman, charged with interfering with custody (removing from state or concealing) and endangering the welfare of a child, had his plea hearing or trial setting continued. Chapman’s father said he is actually paying for the bond, and his son has no attorney. 

Daniel R. Mahan, charged with unlawful possession of a firearm, was arraigned. A plea hearing or trial setting was continued to Jan. 17. 

 

Scheduled or continued to Feb. 7

Dylan M. Burke, who was convicted of possession of a controlled substance in December 2022, had his probation violation hearing continued to Feb. 7. 

 

Scheduled or continued to Feb. 21

William Chamberlain, charged with non-support of a child with total arrears in excess of 12 monthly payments due under a child support order, had his plea hearing or trial setting continued. He’s scheduled to return Feb. 21 for a drug court plea.
