Carter processes 46 cases during December Law Day

Circuit Judge Craig Carter processed a total of 32 criminal cases and 14 civil cases during the Dec. 6 session of Ozark County Law Day. The criminal cases are listed below. 

Cases that reached disposition

Misty L. Gant, who on Oct. 4 pleaded guilty to assaulting a law enforcement officer and driving while intoxicated, charged as a persistent offender, was sentenced to a 120-day institutional treatment program in the Missouri Department of Corrections. She also has back-up sentences of five years for the assault charge and four years for the DWI charge. The sentences are to run concurrently. 

Ryan Padgett pleaded guilty to two counts of distributing, delivering, manufacturing, producing or possession with attempting to distribute, deliver, manufacture, or produce a controlled substance. He was given a suspended sentence and placed on probation for five years. 

Stan Pellham pleaded guilty to possession of a controlled substance, resisting arrest by fleeing, causing a substantial risk of serious injury or death to any person and unlawful use of a weapon. He was given a suspended imposition of sentence and placed on probation for five years. 

Albert Lee Stanford pleaded guilty to second-degree assault by operating a vehicle while intoxicated, resulting in an injury, He was sentenced to a 120-day institutional treatment program in the Missouri Department of Corrections. He also has a seven-year back-up sentence. 

 

Probation and payment hearings

James Byrd, who pleaded guilty to unlawful possession of a firearm in January 2015, appeared for a case review. He has met all probation conditions. He was discharged from probation, and his case is complete. 

Owen R. Dobbs, who pleaded guilty to two counts of burglary and two counts of theft/stealing of property or services valued between $500 and $25,000, had a probation-violation hearing. Dobbs admitted to violating his probation, according to online court records. He was sentenced to a court-ordered detention sanction pursuant to Missouri Revised Statute 217.362, a program for offenders with substance-abuse addiction. 

Cameron Dean Foster, who pleaded guilty to tampering with a motor vehicle in February 2016 and possession of a controlled substance in September 2016, appeared for a probation-violation hearing. The court appointed the public defender to his case. Foster admitted violating his probation, according to online court records. He was ordered to serve three years in the Missouri Department of Corrections. 

Brian Paul Harris, who pleaded guilty to possession of any controlled substance other than 35 grams or less of marijuana, appeared for a probation-violation hearing. He was ordered to served a 30-day shock jail sentence and be continued on probation. 

Heather R. Massey, who pleaded guilty to possession of a controlled substance on July 5, appeared for a probation-violation hearing. She was ordered to serve a 10-day shock jail sentence and be continued on probation. 

Keith Massey, who pleaded guilty to hindering prosecution of a felony on July 5, appeared for a case review. Another case review is scheduled for Feb. 7, 2018.

Blake Medlin, who pleaded guilty to two counts of driving while intoxicated, charged as a persistent offender, in March 2016, had his sentencing hearing on a probation violation continued to Jan. 3, 2018. 

Lisa L. Pankey, who pleaded guilty to possession of any controlled substance other than 35 grams or less of marijuana, appeared for a probation-violation hearing. She has completed a 10-day shock jail sentence and was continued on probation. 

Kelley Mitchell Risley, who pleaded guilty to possession of a controlled substance in November 2016, had his probation-violation hearing continued to Jan. 3, 2018. 

Archie Vincent, who pleaded guilty to non-support of a child with total arrears in excess of 12 monthly payments due under an order of support, had a probation-violation continued. His new court date is not yet listed in online records. 

Angela Marie Wilcox, who pleaded guilty to possession of a controlled substance, admitted to violating her probation. She was sentenced to three years in the Missouri Department of Corrections.

Jeffrey William Kaufman, charged with driving while intoxicated - habitual offender, had his plea hearing or trial setting continued.

Johnathan W. Latham, charged with arson, damage to jail property and property damage, appeared for a hearing. His attorney, Ryan Reynolds, withdrew from the case. Latham filed an application for a public defender, but the application was denied because Latham’s assets exceed the public defender criteria. Latham made a request for a speedy trial. A trial setting or plea hearing was scheduled. 

John Wesley McCullough, charged with possession of a controlled substance, had his plea hearing or trial setting continued.

Amy L. Smith, charged with two counts of possession of a controlled substance, had her plea hearing or trial setting continued. 

William Boyd Spencer, charged with two counts of driving while intoxicated - persistent offender, operating a motor vehicle in a careless and imprudent manner involving an accident and two counts of driving with a revoked or suspended license (first offense), had his plea hearing or trial setting continued.

Brandy Kiger, charged with property damage, driving while intoxicated and driving with a revoked or suspended license (first offense), had her plea hearing or trial setting continued.

Jonathan Dale Troesch, charged with non-support of a child with total arrears in excess of 12 monthly payments due under and order of support, was arraigned. A plea hearing or trial setting was continued.
